"Domain Grabber" sentenced to 22
month on probation.
The first case
against a Domain-Grabber ended with a sentencing of 22 month on probation. A
person from Ingolstadt was accused to have registered 120 domain names between
1997 and 1999, including 22 brand names like Opel and Audi-Lamborghini. The
defendant offered the domains and received from three companies up to DM 4000.
His defense was, that the companies did not have to buy from him. Instead they
could have registered different domains themselves. But the penal court saw his
actions as a clear breach of trademark law. Other civil courts had come to
similar conclusions earlier in Munich. (aj)
