E-Data ist bekannt fuer ein besonders uebles Patent, welches letztes Jahr
von einem Berufungsgericht weitgehend bestaetigt wurde -- wir berichteten.
Es deckt jegliche Feilbietung von Waren im Internet ab.

Nun hat der Chef von E-Data die Feilbietung von personalisierten
Gutscheinen fuer bestimmte Institutionen per Internet patentiert.

Nach den Massstaeben des Europaeischen Patentamtes und der
Generaldirektion Binnenmarkt der Europaeischen Kommission laesst sich
diesem Patent die Technizitaet kaum absprechen.  Es geht darum,
technische Mittel zu nutzen, um gewisse Vorgaeng zu beschleunigen oder gar
erst zu ermoeglichen, die vor der "Erfindung" nicht moeglich waren.  Die
Erfindungshoehe ist natuerlich nach EPA-Massstaeben auch ausreichend ---
das ist sie praktisch immer.   Es bleibt lediglich Neuheit.
Die bisherige Erfahrung von www.bountyquest.com hat gezeigt, dass man mit
diesem Kriterium nur sehr wenigen Patenten beikommen kann.

Interessant ist auch, dass der Erfinder diesmal ein Patentjurist ist.  In
den "neuen Technologien" kann das Patentieren zum Volkssport werden.
Lasst uns alle an die Arbeit gehen!  Patentieren was das Zeug haelt.
Dazu koennen wir auch Organisationen gruenden, die ein wenig dabei helfen
und im Gegenzug dafuer sorgen, dass 10% des Ertrags in die
Anti-Swpat-Lobbyarbeit gehen.

Den Ertrag pressen wir natuerlich vorzugsweise aus Konzernen wie Siemens
und IBM heraus.  Die waren es, die ihren Patentabteilungen freien Lauf
liessen um Musterprozesse zu fuehren, das Recht zu verbiegen und von
Regierungen geplante Studien zu vereiteln.  Heinrich von Pierer weiss
natuerlich von all dem nichts, und seine Telekommunikationsingenieure, die
Patente nur als Bremsklotz sehen und die Patentabteilung mit MIssmut
betrachten, werden ein zweites Mal bestraft.  Aber Unwissenheit schuetzt
nicht vor Strafe.  Die Regel sollte sein:  IBM, Siemens, das BMJ, die GDBM
usw bekommen grundsaetzlich keine Lizenz.  Oder nur zu exorbitanten
Bedingungen.

New Filing Relates to Distribution of Custom Digital Content

today that the company has applied for it's first new patent since acquiring
the Freeny Patent. The inventor is Tibor T. Tallos, President of E-data
