Also,
in Deutschland ist email ebensowenig geschuetzt, wie in Finnland und
das ist meiner Ansicht nach ein Skandal in diesem ganzen riesen 
Spektakel, das sich Politik und Wirtschaft um die Informations-
gesellschaft abhalten. Par. 201 und 202 sind auf Toene bzw auf Papier
beschraenkt, gelten also nicht fuer email. Anderen Schutz gibt es nicht. 
Frankreich wurde mit Urteil des Europaeischen Gerichtshofs fuer
Menschenrechte vom 24. April 1990, Kruslin und Gattin, Huvig,
JCP 1990 ed. G II 2154, note Jeandidier, wegen des mangelnden 
Schutzes der email aufgrund des in Art 8 EMRK geforderten Schutzes des
Briefgeheimnisses verurteilt.  Die Existenz dieses Urteils werde ich an 
Johan Helsingius weiterleiten.
Es duerfte fuer die auf dieser Liste anwesenden Journalisten und
Politiker jedenfalls Anlass genug sein, in Deutschland auf eine 
Aenderung von Par. 201und 202 StGB zu dringen. Das hat auch nix
mit Verschluesselung zu tun, sondern hat weiterreichende Folgen in 
unserer Rechtsordnung, insbesondere die Erforderlichkeit einer Anordnung
nach Par 100a StPO fuer das Abhoeren. 
Ich jedenfalls werde mich im Rahmen von FITUG fuer eine Aenderung
stark machen. Notfalls schreibe ich eben noch eine Presseerklaerung.
