New court orders ICANN break-up

The Court of ICANN Governance today ruled that ICANN had attempted to
monopolise the internet.

ICANN, a California corporation, had monopolised ³the global public
resource² of the internet, said the Court, and ordered ICANN to come up with
a breakup plan by 10 March next year (2001).

Relying on expert evidence about ³root servers², the Court made findings of
fact that other non-ICANN domain addressing systems had been in operation
for years and were growing-- despite the unlawful tactics of ICANN to
control the space.
 
The next week-long meeting of ICANN is in Melbourne starting 10 March 2001.

Already a legal challenge to ICANN is being prepared by Australian lawyers
for filing in the Federal Court of Australia. In a sign of the times, the
case will be commenced by ³e-filing², as a result of recent updates to the
Federal Court Rules to allow the uses of new technology.

It is not yet confirmed whether ICANN attorneys Messrs Sims and Touton will
be available in Melbourne to accept ³service² of the Court documents.
