One has to choose or the parties have to agree.
Which leads to yet another dispute.
The mediators / arbitratores are commissioned by ICANN.
ICANN did choose generally accepted ones.
You, and everybody else, are free to suggest additional ones.

Sorry, but this is wrong. The other party gains too. 
F.e. the security without court fees.

UDRP is not the solution to every problem.
It is not perfect. It does not solve any flaws 
in the legal system. 
Done properly, it is a fair and inexpensive tool.
