Re: [ICANN-EU] Re: [icann-candidates] Re: [ga] bodacious-tata[s].NET

Marc,
Absolutely. I certainly do not oppose the UDRP but I wish it
to be imporved:
-  in including a Domain Name definition, since you cannot
state on somehting you do not know.
-  in having at least a counter-power. This "bodacious-tata"
strory could help a lot. Humour is sometime very wise.

I am NOT a lawyer, not competent enough (I am just a user
with needs, proposing ways to obtain the responses I miss).
We could set up a ML for people with that spirit (humour to
keep UDRPs in good tracks and provide a kind of apeal
through community awareness).

Let me know: I will setup an udrp-tata@egroups.com list.
I like Marcs .org site. If someone is interested in running
the .net site?

From former discussions you know, that I am pro UDRP.
That does not mean, that I accept all the decisions made through it.

The idea of an award for lousy decisions is great.
If needed, I'll gladly sponsor it.
Maybe we could develop it into something
similar to legal aid for an UDRP appeal?

I can be fast, yes, let us keep that possibility open for new domains :-))

I nearly registered the .net myself, but thought .org was more in tune
with the original purpose of the TLDs. Even if this has been given up
officialy.

You could make this a weekly award. Plenty candidates.

My main concern is that this case sets a precedent. The TM lobby cleverly
moves ahead with a case against a porn domain for which nobody has much
sympathy, or rather does not want to show sympathy. Next time someone from
wherever who calls his company Fun may claim all domains with fun in it.

I doubt the owner of bodacious-tatas.com will fight this case in court. It
is probably not worth the money it costs. So we must fight it in the
press. Setting up a little site is a good (and inexpensive) way to get
attention. I hope...

By all means!
