[atlarge-discuss] FW: Your message to Atlarge-info awaits moderator approval
JFC has invaded my letterbox with Spam using data that he obtained from
ICANNATLarge.com and .org, in such a way that neither I, not the current
Panel, can stop him unless he cooperates voluntarily. In addition, any
attempt on my part to contact fellow victims to discuss ways in which we can
collectively come together as a force to stop the offending Spam is at the
sole discretion of the same JFC, being owner of the unauthorized spamming
list. What is wrong with this picture?
IANAL, but the way I see it right now is this:-
1) The victims' personal contact details were passed to a spammer, who then
disclosed the data on a list in the form of spam, which thousands of people
read.
2) The spammer is now collecting further data from replies to the list, thus
enabling a new database to be created, which can be sold or bartered, again
without the knowledge or consent of the victims whose data comprises the
list.
3) The victims have no mechanism to resign membership of the organization(s)
which may have betrayed their trust in this way. Requests to unsubscribe
from the spam mail list have been met with silence.
2) Since most of the victims were unaware that the JFC spamming action had
not been authorized by the Panel, the reputation and name of the
organization, ICANNATLarge.com & .org, has been damaged by the incident,
misleading members into thinking that another, privately owned and operated
initiative with a confusingly similar name, was in fact, the ICANNATLarge
organization into which they had originally enrolled.
3) Since most of the victims were unaware that such action had not been
authorized by the Panel, a significant number have left in disgust as a
result of spam, which they perceive as organization incompetence, amongst
other things.
4) This in turn has reduced participation levels, so there are now fewer
prospective member contributions and lower organization revenue can be
expected until numbers are built back up again, which could take some time
to engender the trust, if ever.
5) This is a critical time in the organizations history to be losing any
prospective revenue sources, especially with the ALAC pressing for
disclosure of funding sources from At large organizations with whom it is
looking to deal in the immediate future.
6) JFC, a citizen of the EU where there are laws that prohibit third party
disclose of personally identifiable information, is using a membership
database that he acquired under questionable circumstances from ICANNAtLarge
for one purpose, namely the election, and applying it to another purpose,
which may include building a completely separate organization comprising
members who have never consented to be enrolled.
7) There is no mechanism by which the victim may cancel membership of any of
these so called organizations, or force the perpetrator to stop, save by law
enforcement, which on the face of it may include:-
1) Reporting JFC to his ISP for Spam offense
and/ or/
2) File a lawsuit against those running ICANNATLarge.com/.org (Panelists)
for the unlawful disclosure of personally identifiable contact information
of EU members thru a spam mailing list.
