Verbindungsdatenspeicherung auf EU Ebene kann durch Deutschland verhindert werden

Bis Freitag besteht die Chance das Data Retention Vorhaben im Europäischen
Parlament zu beeinflussen. Die 99 deutschen Abgeordneten wissen zu großen
Teilen nicht einmal, um was es geht.

Es ist wichtig, die Einreichung von Cederschiöld zu unterstützen. Leider
ist nicht sicher, ob die hauseigenen Experten den Sachverhalt korrekt
einschätzen. Die Abgeordneten sollten sich also nicht auf diese Experten
verlassen!

Wer kann, sollte JETZT einige Abgeordnete des Europaparlaments oder deren
Büros über die Wichtigkeit der Entscheidung informieren. Eine
Fehlentscheidung vergrößert die Überwachungsmöglichkeiten in Europa!

LATEST NEWS ON DATA RETENTION

The plenary vote will be in Strassbourg, on Tuesday 13 December, 12.00 
AM. There will be a debate Monday evening 12 December. There is a 
compromise by christian-democrats and social-democrats to completely 
accept the Council proposal.

A very large majority of MEPs has no idea at all what data retention is 
about, and just follows the voting list presented to them by the 
experts in their group. In the case of the 2 largest groups in the EP, 
the 'experts' have no idea themselves what data retention is about; 
Hans-Gert Poettering (German Christian Democrat) and especially Martin 
Schulz (German Social Democrat).

The possibility to file amendments just closed. There are only 2 filed. 
One by the Greens/EFA to reject the entire directive. We should really 
applaud them for this, in spite of the fact that chances of success are 
zero.

And the second one is filed by the excellent MEP Charlotte Cederschiöld 
from Sweden.  With the support of 37 MEPs, mostly ALDE and PPE she is 
asking in her amendment to reinstitute article 10, the cost 
reimbursement for the industry. This is a _VERY_ important breach in 
the ranks of the christian-democrats. Not because she feels sorry for 
the industry, but because she does not want consumers to pay the burden 
for this legislation.

If this amendment is supported by 370 MEPs in the vote, it will be 
accepted and will lead to a second reading in parliament for sure, 
under the ever so welcome Austrian EU presidency. Cost reimbursement is 
completely inacceptable for the Council.

If you want to help raise support for this amendment in contacts with 
MEPs, please take care about the wording. Do_not_ to say it is unfair 
towards industry. The argument is the other way; Cederschiold is 
defending consumer rights, and does not want us to pay the burden.

Besides, any investment in data storage for law enforcement purposes 
will not benefit the industry at all, given the fact they are banned 
from using it for any business purposes. Fiona Taylor from ETNO did a 
very good job explaining this today in the hearing in the EP. Operators 
will have to build a second database if they have a commercial interest 
in for example location data...
