common carrier heisst - wenn ich das richtig verstehe - nach dem
Weltfernmeldevertrag.de "anerkanntes Betriebsunternehmen" und das
ist dort definiert als solches, denn es ist in der Lage,
"schaedliche Stoerungen" zu verursachen (so habe ich es in Erinnerung).

1d: Zuerst moechten Leitung und Mitarbeiter von Web Communications
klarstellen, dass wir Antisemitismus und alle anderen Formen von
Hass und Rassismus ablehnen.

2d: Trotzdem beachtet WebCom eine klare Firmen-policy, dass wir in keiner

Die Neonazi-Propaganda, auf die die Deutsche Telekom mit Sperrung
unseres Netzzuganges und unserer Computerdienste reagierte, wurde
von einem Kunden von Web Communication verbreitet und *nicht* von
Web Communications selbst.

3d: Wir verstehen, dass die erste Frage, die die Oeffentlichkeit uns
stellt, lautet: Wenn wir, zusammen mit allen anderen empfindsamen,
intelligenten und wohl erzogenen Menschen, so absolute Gegner der
Neo-Nazi-Propaganda sind, die ueber unseren Dienst verbreitet wird,
warum kuendigen wir diesem Anbieter nicht?
Das sind unsere Gruende.

4d: Es ist eine unbedingte Notwendigkeit fuer unseren Betriebsmodell,
dass wir den Status eines "common communications carrier" behalten.
WebCom bietet WWW, E-Mail und andere Dienste guenstig an durch
Selbstbedienung, Automation und hohes Volumen. Die Datenmasse macht
Ueberwachung und Editieren unmoeglich und teuer.
Gerichtsentscheidungen haben gezeigt, dass in dem Moment, wo ein
Onlinedienst in der geringsten Weise editiert oder Inhalte begrenzt,
dieser Dienst als Verbreiter von Information (publisher) gesehen
wird und - in der Folge - letztlich haftbar gemacht wird fuer
*alle* Inhalte, die seine Kunden vorhalten.

Wir sind der festen Ueberzeugung, dass der einzige Weg, mit dem
wir unseren Status als "Common Carrier" behalten, in der Einhaltung
unserer strengen Richtlichen liegt: wir ueben *keinerlei* editorische
Kontrolle ueber *irgendeine* Kommunikation unserer Kunden aus, solange
ihre Kommunikation gesetzlich zulaessig ist.

5d: Die Einstellung des Dienstes oder irgendeine andere Kooperation
mit den deutschen Behoerden bei ihrem Wunsch, die Zuendel Website zu
zensieren wuerde dazu beitragen, einen Praezedenzfall zu schaffen.
In der Folge koennten auslaendische Regierungen aus aller Welt ihre
Wuensche mit der Zensur der Zuendel Website begruenden und auf
jeden Internet Dienst ausdehnen, wie es ihnen gefaellt.
Genau das wuerde unserem ureigensten Anliegen widersprechen:
die Entwicklung einer vielfaeltigen internationalen Graswurzel
Kommunikation zu foerdern, die dank des Internet erst moeglich ist.

>5e: Terminating service or otherwise cooperating with the German
>government in their desire to censor the Zuendel Web site would
>help to establish a precedent in which foreign governments all over
>the world would be able to exercise censorship over any Internet
>communications which they find objectionable.  Such a state of

6d: Wir wurden von keiner Seite in irgendeiner Form darauf
hingewiesen, dass die "maintainers(s)" der fraglichen Website
gegen irgend eine Regelung unseres Dienstes oder irgendein
anwendbares Gesetz verstossen haetten.

>6e: We have not been notified by anyone, let alone an officer of
>any U.S. court or law enforcement agency, that the maintainer(s)
>of the Web site in question may be conducting any activity via our
>services which violates any applicable local, state or federal law.

7d: Wir sind der festen Ueberzeugung, dass die Verfassung unseres
Landes die einfache gewaltlose Meinungsaeusserung - wie unpopulaer
sie auch sein mag - als grundlegendes Menschenrecht betrachten,
das nicht verletzt werden sollte. Auch wenn der fragliche Kunde
kein U.S. Buerger ist, so ist doch das WebCom Netzwerk eine
amerikanische Kommunikationseinrichtung und wir glauben, dass
das Recht auf freie Rede in unserer Verfassung nicht nur ein
amerikanisches Recht ist, sondern in der Tat ein Menschenrecht.

>7e: We believe that our country's constitution gaurantees that the

>ideas may be, is a fundamental human right which shall not be
>violated.  Although the customer in question is not a U.S. citizen,
>the WebCom communications network is an American communications

8d: Wir glauben an die grundsaetzliche Bedeutung einer Vielfalt von
Kommunikationsmoeglichkeiten. Das Vorhandensein anderer Standpunkte,
The presence of other viewpoints, no matter how loathsome, forces
us to make moral judgements and to think about and consider the
issues they raise.Ignorance is  dangerous; when opposing views are  
suppressed, instead of exposed and refuted, the result is that we
are unprepared or incapable of countering them when they do emerge.

>8e: We believe in the fundamental value of diverse communications.
>The presence of other viewpoints, no matter how loathsome, forces us
>to make moral judgements and to think about and consider the issues
>they raise. Ignorance is  dangerous; when opposing views are

9d: Jeder unserer mehr als 1500 Kunden kam zu uns mit der klaren
Vorgabe, dass nach unserer "policiy" sie selbst und nur sie selbst
allein und umfassend verantwortlich sind fuer die Erstellung, Pflege
und Verbreitung ihres eigenen Materials in Kenntnis der moeglichen
Rechtsfolgen ihrer Publikationen oder Kommunikation.
Dieses Einverstaendnis geschieht formell durch die Unterzeichnung
des "service agreement". Dieses unterschreiben alle unsere Kunden.
Wir sind der festen Ueberzeugung, dass wir nur bei strikter
Einhaltung unserer "policy" das Vertrauen unserer Kunden behalten;
das gilt fuer Gerichte entsprechend.

>publicization of their own materials, as well as any legal issues

10d: Zu den philosophischen Gruenden kommen seitens der Gruender
von Web Communications sehr persoenliche Gruende dazu, in aller
Schaerfe die Inhalte auf der Zuendel Website zu verdammen.
Die Grossmutter muetterlicherseits von unserem Praesidenten
Chris Schefler musste in einem Konzentrationslager der Nazis
sterben.
A sister church of the church to which our Vice President Thomas
Leavitt belongs suffered the extermination of its entire clergy in
southern France by the Gestapo.

>10e: In addition to philosophical reasons, the founding officers of

11d: Trotz allem beabsichtigt WebCom aus den vorher aufgefuehrten
Gruenden die Bereitstellung der Dienste fuer den Account von Ernst
Zuendel unveraendert fortzufuehren wie bei jedem anderen Kunden auch.
Sollten wir von U.S. Behoerden erfahren, dass ein Kunde bei der
Nutzung unserer Dienste irgendein amerikanisches Gesetze verletzt
oder Zahlungsverzug eintritt, wird der Account beendet.

>11e: Nonetheless, for the reasons previously outlined, WebCom intends
>to enforce the service agreement with the Ernst Zuendel account
>exactly as it is enforced with any other customer.  Namely, if we
>are notified by U.S. authorities that the customer is using our

12d: Schefler und Leavitt haben a long record of commitment to

causes, and actually met while working for California Peace Action,
a grassroots progressive citizens lobby.
Sie beschlossen, found Web Communications not only because they
recognized an in credible business opportunity, but also because they
recognized the Internet as having the potential to be an incredible
catalyst for positive planetary change by uniting people all over the
world in diverse grassroots communications in a many-to-many format
never before possible.  We believe that if the invention of moveable
type helped bring Western civilization out of the dark ages,
then the Internet, which is really just an extraordinary enhancement
of that invention, has  an almost unfathomable potential as a catalyst
for positive social change.
