Joanna, all of this is ridiculous. First of all, because even in the
unlikely case that someone at ICANN decided to sue icannatlarge.com, it
cannot sue a non-existing organization - so in the end the only ones that it
could sue are the owners or managers of the web site, i.e. Bret and Joop.
And even if the organization existed, ICANN would sue the organization, not
its individual members! Of course the Directors of a company have
responsibilities for crimes committed by the company. But we are not even
formally existing yet!!
So shouldn't we focus on proceeding with real steps, rather than losing
weeks on a petty flame about how we call ourselves?? I am sorry, but I think
that this whole name thing has been mismanaged to the point of making
ourselves ridiculous and raising attrition among the members, while keeping
this organization strong and united should be our first goal - after all,
our members, not our name, is all we have.
And personally, I think that the Chair, especially because he/she is the
Chair, should avoid to take positions on what the results of a vote should
be after voting has already begun, let alone trying to change such results
by authority, by excluding one possible outcome, without clear support in
the membership or at least a vote by the panel. This is a theoretical
problem that might perhaps rise in the future (perhaps, because you didn't
even do the simplest thing to understand whether it's real or not: ask ICANN
whether they agree with this usage or not) and you are using it as a tool to
influence the results of the vote while it is running. This is not, in my
opinion, what a Chair should do.
Instead, there are a number of rational approaches you can take to calm the
situation, as the Chair should do. First, let's wait and see what the vote
results are. If we want a name with ICANN in it, then we might ask ICANN
whether they would have anything against it, and if they had, we might seek
legal advice and submit it to the membership for consideration. And then we
all - *we all*, not you alone in the leap of a minute - take a decision.
