Summary, 1 Oct - 15 Oct 2002

Joanna Lane posted a remark about the previous Summary, where I wrote:
"1) Possible personal liability of Chair for Trademark infringement",
she pointed out:
>"This misses the most important point entirely, (as did the majority of
>readers at the time), which is:
>"1) Possible personal liability of *Panelists* for Trademark infringement".
>[...] I acted to protect not the Chair alone, but the whole Panel. The membership [...]

On Monday, October 1, Hans Klein communicated that the Panel has adopted
a voting procedure:
http://www.fitug.de/atlarge-discuss/0210/msg00009.html
Discussion prompted by Sotiris Sotiropulos:
>I was simply stating my concern that whatever votes
>are carried out by the Panel are not done secretly or anonymously. The Panel
>ought/must vote in a public fashion, such that the membership may know which
>Panel member voted for or against what position.

A number of messages deals with website or website management, among
others these threads:

Chris McElroy, citing from two exchanges on list, said:
"I make a motion that we do re-vote on the name issue"
and suggested a list of priorities (which revisited some topics, as
differences between U.S. and Canada incorporation's and fiscal rules,
and a debate on website forum last May about the mission ("narrower" or
"broader"):

In one of the usual discussions about someone's identity, Vittorio
Bertola wrote:
>However we don't have any procedure or approved policy on this. I think we
>must approve one before practically doing anything. [...]: when one member's identity is challenged, do
>we consider him "real" unless reasonable proof of his fakeness is given, or
>do we adopt the opposite approach? [...]

On Oct.2, Walter Schmidt found that:
>Yet, www.icannatlarge.org does NOT resolve!?!
>FWIW, www.icannatlarge.com resolves to Joop.
This was verified with different whois services and much commented.
On Sunday, Oct.6, Curtis M. Kularski:
>Here is what I see:
>	We voted on ICANNATLARGE.ORG, ATLARGE.ORG came in second; Marc
>has control of both.
Marc Schneiders confirmed that
>the organization can have it, naturally.
>Let me know what to do with it, and it will be arranged in no time.
>For now I have set up the dns so that it points to the
>icannatlarge.com website, both with and without www. I hope that is
>OK.

For webhosting services, "No one here needs to worry about
webhosting services until June, 2003" according to Bret Fausett:
http://www.fitug.de/atlarge-discuss/0210/msg00210.html

Among other arguments raised in the discussion, Curtis asked for the
registration requirements in .INT, and Hugh Blair posted the link with
his detailed comment:

Being online the ERC Final Implementation Report, Vittorio Bertola
forwarded a message sent to ERC about unresolved issues about the ALAC:
http://www.fitug.de/atlarge-discuss/0210/msg00130.html
Some days after, Vittorio pointed to the new supplemental implementation
report:
http://www.fitug.de/atlarge-discuss/0210/msg00446.html

A citation of George Bernard Shaw:
http://www.fitug.de/atlarge-discuss/0210/msg00232.html
on censorships revamped the discussion in different threads.

Danny Younger pointed to Panel's work starting a long discussion from
the case of two motions not reaching quorum:
http://www.fitug.de/atlarge-discuss/0210/msg00280.html
[The name motion was later approved, in this wording:
"The ICANN Panel accepts ICANNATLARGE.ORG as our name and primary Web
URL, based on the vote of our membership.]
Richard Henderson maintain the discussion open about having a larger
vision: "we should consider using www.atlarge.org as the structural base
for our organisation"
http://www.fitug.de/atlarge-discuss/0210/msg00477.html

How to proceed to build the organization is debated.
Chris McElroy:
>first comes the
>mission statement, then bylaws, then articles of incorporation. These things
>have different names in different places such as mission statement might be
>called statement of purpose, but the meanings are similar
http://www.fitug.de/atlarge-discuss/0210/msg00313.html
Jeff Williams:
> You do not need a mission statement to file for 501 c3 status. You
>do need a charter. You must be developing bylaws and be able
>to show that clearly. And you must have articles of incorporation.

Eric Dierker provided links to California law in this message, with
comments:
http://www.fitug.de/atlarge-discuss/0210/msg00346.html
David Farrar explained the benefits of registering a non profit
organisation under NZ law:
http://www.fitug.de/atlarge-discuss/0210/msg00376.html
Jeff Williams again quotes some opinions here, with his comment:
http://www.fitug.de/atlarge-discuss/0210/msg00513.html

Eric started the discussion about ICANN's Shanghai meeting:
http://www.fitug.de/atlarge-discuss/0210/msg00057.html

Many other posts refers, less or more explicitly, to the items on
ICANN's Agenda, like reassignation of .ORG, domain name transfers and
deletes, whois, relations with ITU and WSIS.
(Updated schedule and agenda of Shanghai meetings on ICANN site).
